New Balance settled a claim over claims that some of their shoes are ‘made in the usa’ in 2019. They make the claim that those shoes that have that label are substantially made in the USA even though components for those shoes are not made in the USA. Now another class action has been filed by consumers over the “Made in USA” claims by New Balance.
It is initially not clear what this new class action adds over the previous one and if the claims are novel. The claims in the suit allege that the New Balance products that have this tagline of “Made in the USA” are not entirely made in the USA that is misleading to the consumers. They are seeking $5 million in damages. New Balance claim that the shoes meet the Federal Trade Commission criteria to make that claim.
